The Pension Regulator: AE Industry Liaison Manager update - June 2015

If there are any particular topics you would like to hear about, your feedback would be welcome. Please feel free to circulate this email to appropriate colleagues and any third party contacts and introducers.

Enquiries on postponement have continued to be popular at our call centre

Do employers have to notify us that they’ll be using postponement from their staging date?

  • No, they don’t have to notify us if they intend to use postponement.
  • However, they’ll be asked what their latest deferral date (ie the last day of postponement) was when they complete their declaration of compliance with The Pensions Regulator following their staging date.
  • It’s important to note that, if they do apply postponement to a member of staff or a group of staff, they must issue them with postponement notices.

Can postponement be used more than once per worker?

  • Employers can apply postponement on their staging date, a member of staff’s first day of employment and the date that a member of staff meets the criteria (eg their 22nd birthday). If, on the deferral date, a member of staff is assessed as an eligible member of staff, they’ll need to be automatically enrolled and postponement cannot be applied again in this instance. If they are not assessed as meeting the eligibility criteria on that date, they can be postponed again the next time they meet the eligibility criteria. An employer cannot have more than one postponement in force per worker at any time. Postponements cannot overlap.

Do you have any events planned on automatic enrolment?

As part of our education and enablement approach we attend and speak at events on automatic enrolment.

The focus now is very much on ensuring that small and micro employers comply with their duties. Providers and advisers are reviewing their propositions to cater for the different needs of smaller employers.

Some business advisers will be new to automatic enrolment and will be assisting their clients for the first time.

Would you like help with the education of your own business advisers and support staff to enhance their detailed knowledge or to raise awareness and understanding with your third party introducers?

Our presentations offer an explanation of the regulations as well as insight into lessons learnt and we tailor the content  to meet the needs of your audience. We encourage participants to ask questions to gain as much from the session as possible.

Some of the topics we can cover are:

  • An overview of the employer duties
  • Detailed understanding of the employer duties
  • Compliance and enforcement update and lessons learned from employers that have staged
  • Changes to the legislations from 1 April 2015
  • Cyclical re-enrolment duties

If you would like to request a member of the industry liaison team to speak at an event, please complete the speaker request form using the link below. Please let us know the topics you would like us to cover and the target audience. We typically need a minimum of an hour to present and answer questions and an audience of at least 20.  If you would like to discuss the details prior to submitting the request then please contact me.
